1. OWNERSHIP & DISCLOSURE DECLARATION

I, the undersigned, hereby declare that: • I am the lawful owner / authorized custodian of the above-mentioned bird. • I have fully and truthfully disclosed all relevant information including health history, behavioural traits (biting, aggression, screaming, plucking, etc.), dietary habits, and any prior medical conditions. • Any non-disclosure or misrepresentation shall be solely my responsibility and liability.

2. HEALTH & QUARANTINE ACKNOWLEDGMENT

I confirm that my bird is not knowingly carrying any infectious or contagious disease at the time of handover. I understand that despite precautions, cross-contamination risks cannot be completely eliminated in a multi-bird environment. CuddlyWings reserves the right to isolate, refuse, or discontinue boarding if health concerns arise.

3. ASSUMPTION OF RISK

I expressly acknowledge and accept that: • Birds are fragile, prey animals prone to stress and sudden health complications. • Risks include but are not limited to: 1. Stress-related illness 2. Injury (self-inflicted or accidental) 3. Escape despite reasonable precautions 4. Sudden or unexplained death I voluntarily assume all such risks, whether foreseeable or unforeseeable.

4. LIMITATION OF LIABILITY

To the fullest extent permitted by law: I agree that CuddlyWings, its owner, employees, handlers, and representatives shall NOT be liable for: • Illness, infection, disease (including latent or stress-induced conditions) • Injury, escape, loss, or death of the bird • Behavioural changes including aggression, regression, or trauma • Any indirect, incidental, or consequential damages Liability, if any, shall be strictly limited to the amount paid for the service.

5. VETERINARY CARE AUTHORIZATION

I authorize CuddlyWings to seek immediate veterinary care in case of illness or emergency. All expenses (consultation, treatment, medication, transport, hospitalization) shall be borne entirely by me. I understand that treatment outcomes are not guaranteed, and CuddlyWings is not responsible for veterinary results.

6. TRAINING DISCLAIMER (APPLICABLE IF SELECTED)

I acknowledge that bird training is behaviour-based and not guaranteed. Results vary depending on the bird’s temperament, age, prior conditioning, and owner consistency. I agree that no specific behavioural outcome, tameness, or talking ability is guaranteed. I understand that training may involve controlled exposure, handling, and behavioural conditioning, which may temporarily stress the bird.

7. TRANSPORT & HANDLING RISK

Any transportation arranged (pickup/drop) is undertaken at my sole risk. CuddlyWings shall not be liable for injury, stress, escape, or death during transit.

8. INDEMNITY (DEFEND, HOLD HARMLESS & COMPENSATE)

I hereby agree to defend, indemnify, and hold harmless CuddlyWings, its owner, employees, and agents from and against: • Any claims, demands, legal actions, or proceedings • Any damages, losses, liabilities, or expenses (including legal fees) arising out of or related to: • My bird’s stay, behaviour, or health condition • Injury or damage caused by my bird to any person, property, or other birds • Any third-party claims connected to my bird

9. ABANDONMENT & DELAYED PICKUP

If the bird is not collected within 3 days after the agreed end date without communication: • Additional charges shall apply. If uncollected for 7 days or more, CuddlyWings reserves the right to: • Rehome, transfer, or take necessary action without liability.

10. PAYMENT TERMS

Full/partial advance payment is mandatory. Fees are non-refundable, including early pickup or cancellation. Additional charges apply for extended stay, medical care, or special handling.

11. FORCE MAJEURE

CuddlyWings shall not be held liable for events beyond reasonable control, including but not limited to: • Natural disasters • Fire, accidents • Government restrictions • Pandemics or unforeseen emergencies

12. GOVERNING LAW & JURISDICTION

This agreement shall be governed by the laws of India, and any disputes shall fall under the jurisdiction of courts in Mumbai, Maharashtra.

13. MEDIA CONSENT & USAGE RIGHTS

I hereby grant permission to CuddlyWings to photograph and/or record videos of my bird during boarding, training, or related activities. • I agree that such media may be used for marketing, promotional, educational, and social media purposes, including but not limited to Instagram, YouTube, and other digital platforms. • I understand that: • No monetary compensation shall be payable for such usage • Ownership of all such media shall remain with CuddlyWings • If I wish to opt out, I will inform CuddlyWings in writing prior to boarding.

14. PARIVESH REGISTRATION & LEGAL COMPLIANCE DECLARATION

I acknowledge that, as per applicable regulations in India, registration of exotic bird species on the Parivesh Portal (Ministry of Environment, Forest and Climate Change) is mandatory where applicable. I understand and agree that: • In case of non-registration, incorrect declaration, or non-compliance, I shall be solely responsible for any legal consequences • If any forest department, wildlife authority, or government body takes action, including inspection, seizure, or confiscation, CuddlyWings shall not be held liable under any circumstances • Any disruption, loss, or damages arising from such action shall be entirely at my risk • I further agree to indemnify and hold harmless CuddlyWings against any legal action, penalties, or claims arising out of non-compliance with Parivesh or any wildlife regulations.
